Judge dismisses Nirvana's 'Nevermind' child pornography lawsuit

Nirvana have won a motion to remove a lawsuit against them that claimed the baby on their ‘Nevermind’ was child pornography but it’s not over yet...

If you missed it - earlier in the year, the now-grown-up baby on Nirvana's 'Nevermind' album cover filed a lawsuit against the band, alleging that the ‘nude’ image of himself is child pornography.

The case was thrown out because allegedly Elden didn’t meet a deadline to respond to the motion to throw the case out. Elden can refile the lawsuit however he only has until the 13th of this month or else the case will be permanently dismissed. Nirvana’s motion to dismiss the case claims,

“Elden has spent three decades profiting from his celebrity as the self-anointed ‘Nirvana Baby’,”

“He has reenacted the photograph in exchange for a fee, many times; he has had the album title ‘Nevermind’ tattooed across his chest; he has appeared on a talk show wearing a self-parodying, nude-colored onesie; he has autographed copies of the album cover for sale on eBay; and he has used the connection to try to pick up women.”
